nikita28
Hi, I have an approved i140 with my past company whose PD is current. I have a second i140 with my present company with MTR pending. Can I apply for a new i140+ 485 concurrently and also port my PD? Thanks so much Nikita Link to comment
Belle
New I-140? Do you have another LC approved? You can probably file I-485 since the date is current, but if the I-140 MTR is denied, you are going to lose your I-485 filing fee. Link to comment
nikita28
Can any attorney or other member please help with this? I am in a rush to get this in. Really appreciate it. Thanks! Link to comment
nikita28
The new i140 is based on same labor. Lawyer told us that the new i140 will be considered as a new case even if mtr gets denied. Link to comment
Belle
You should withdraw the MTR, then. I guess, it's possible. The question is whether the new I-140 will end up in the same spot. Link to comment
