paul_1982 Posted December 15, 2011 Report Share Posted December 15, 2011 I am presently on L1B visa working with employer X. Company Y had applied for new H1B petition and it got approved. Till now I have not joined company Y on H1B. In the mean time i have full time position from company Z. If it is possible to transfer my fresh new H1B petition from employer Y to employer Z? I can show the current paystubs of my current L1 employer and if it will be acceptable ? Please suggest so as i can make my decision. Link to comment
Attorney_10 Posted December 16, 2011 Report Share Posted December 16, 2011 Generally, an individual must be maintaining valid nonimmigrant status to be eligible to change or extend status in the U.S. It appears from your facts that you may be out of status if the H1B petition was approved for a change of status. Thus, your facts appear complex and you should schedule a consultation with an experienced immigration attorney as soon as possible to determine what steps needed to be taken. Link to comment
