sunil_826
Hi...I recently got my 1st term of H1B visa extension for 3 yrs. My current employer is filing i-140 for me, and my client offered full time, and they would file for my GC again by end of next year. Should I wait until my current i-140 gets approved (via premium processing) before I transfer my H1B to my client. If my client insist me to transfer immediately, and by the time my H1 transfer is done, if I already apply for i-140 (from my current employer), will that become invalid ? Or Should I insist back with my client to wait until i-140 from my current employer gets approved ? All this is just to claim the priority date from my current GC process, and use that when my future employer (my client) applies GC for me. Can someone suggest me the best possible option ? gharik25
Wait till your i140 gets approved by your employer and then join the client as you can get a priority date which can be portable in the future. Link to comment
