I have my labor approved with my current employer and will be applying 140 soon. In future when I return to US new employer after say more than an year, can I port my priority date with the approved 140 from my current employer. Thank you. Link to comment
sameern Posted December 15, 2011 Report Share Posted December 15, 2011 As long as you have a copy of I-140 approval, you should be able to port the priority date. PS: As per my understanding, I-140 is the property of the employer so they don't have to share it with the employee. But I have read on this forum that there's a way to get the I-140 from USCIS.
