bucketlist
Question regarding: Filing Adjustment of Status (AOS) for my spouse when my priority date is current. While filing the following for my spouse: 1. G325A(Biographic Info), 2. I485(AOS), 3. I-693 (Medicals), 4. I765(EAD) - Optional, 5. I131(AP) - Optional, as a derivative of the primary applicant (myself) that has I140 approved and a pending I485 as of date: 1. Does my spouse need to file Affidavit of support? 2. If so which one Form I-864 (or) Form I-134? 3. Copy of my approved I140 need to be sent? Also, what are all the other supporting documents, my spouse should file along with the completed application forms? Can anyone give me a checklist (or) a legal source of information? Please advise me if I'm missing anything. Thanks. Link to comment
Belle
Read I-485 instructions. Affidavit of support is not needed because it is an EB case. You need to include either an EVL or a job offer letter to confirm your (primary's) income. Link to comment
ram2008
1. Does my spouse need to file Affidavit of support? No 2. If so which one Form I-864 (or) Form I-134? Yoh have to submit a letter from employer (EVL) thats all. 3. Copy of my approved I140 need to be sent? Better to submit I-140 approval if you have otherwise atleast I-140 receipt notice. Here are the list of docs that I know. Birth Certificate Marriage Certificate I-485 (Adjust of Status) G-325A (Biographic Info) I-693 (Medical) 6 photos passport copies I-94 copies Employer Letter I-140 approval/recipt notice I-485 receipt notice Cover Letter Link to comment
ram2008
Can I file 1-485 without filling I-785 and I-131 for my spouse? If so what is the the fee? This is not clear in the instructions. Link to comment
Attorney_6
The filing fee is a flat fee---the same with or without the I-765/I-131. The forms used to have separate fees, but, that changed in mid 2007. Link to comment
