She would have to get an H4 visa and use that to enter. Hey Joe, Question for you, I also had filed for my wife H1 to H4 on July 29. She got and RFE on 9th Dec. She is planning to go to india Jan 2nd 2012. The lawyer says its good because she can go there and while coming apply for her h4 and get its stamped along with me as i am also planning to be there. In the mean time lawyer will respond to RFE. He also mentioned the same thing that she would not need this change of status then. do you think its safe to do this? Link to comment
