help on h1/h4 situation....urgent

Hello all

i applied for h4 after 4 months its got refused and husband petiiton sent back to uscis but till date no update from uscis.and today with visa bull my husband GC dates becomes current its dec 2008,and now my question is:

1...as his petion is under review but no update from uscis so can he file his i-485?

2...as i am out of country this time so can he put my name on his i-485 process.

please suggest

consulat an attorney.

pls post the query in 485 forum. 485 requires your presence in the US. He can file his 485; but if it gets approved before you can join him, you have to follow to join by interviewing at consulate for immigrant visa.
