ragas Posted December 9, 2011 Report Share Posted December 9, 2011 Hi, I am in the current situation, which has unfolded over the last week. ============================================================================ Has a valid petition and 1-94 till 10th Dec 2011. Applied for an extension in September 2011. Got a new petition (I-797) till Sep 19th 2012. Went to visa stamping to Tijuana on 6th Dec 2011.Got 221g. Old visas are cancelled without prejudice. Consulate has taken new 1-797, LCA and client contract. Went to border, showed old I94, to pursue AVR (Automatic Visa Re-validation), which I later found is not applicable for me. Passport was swiped. Was allowed into US on 9th Dec 2011 on the old I-94 and old petition. I was not given a new I-94 Should I leave the country immediately and leave to Home country, and return to Mexico when the 221g is cleared. Or can I stay in us and go to Mexico when asked to come for the followup interview. ============================================================================ Please let me know.
