black_ice Posted December 9, 2011 Report Share Posted December 9, 2011 Dear All, I came to US on Jun 09 on H4 Visa and applied for a H1B on Oct 09 and got approved on Jan 10. My project got cancelled on Dec 09. Apparently i couldn't start working from Jan 10. I was on bench until May 10 (No Paystubs/W2) and decided to go back to India and come back as H4 since i couldn't any project. My husband's company is processing his green card (140 approved). Until now i am in H4. Will there be any issue when we file for I-485 since i have not worked between Jan 10-May 10? Any advise is appreciated. My husband's record is clean and he is primary. Attorney_7 Posted December 11, 2011 Report Share Posted December 11, 2011 Generally, in an adjudication of an I-485 application, the USCIS reviews the applicant’s maintenance of valid status since his/her last entry to the U.S. is reviewed. Link to comment
