L1 visa lay off

Hi All,

One of my friend on L1 visa , he got laid off last week , they gave time until jan 15th, is there any option he can work here without returning to India.

Please give me some advise ASAP.

A person in L-1 status ordinarily loses this status if he is terminated from the company. However, prior to losing his status, he may be able to have a new employer file a change of status (perhaps to H1B.) A timely filed, non-frivolous petition will generally then place the foreign national in a period of authorized stay while the petition is being adjudicated. If approved, he could then begin to work for the new employer.

You should have your friend contact an experienced attorney to review his complete immigration history and help him determine the best course of action. He should do this BEFORE the January 15 deadline.
