firefox Posted December 5, 2011 Report Share Posted December 5, 2011 Hi, I recently received renewal of I-797 with start date march 9 2012. My currentl h1b visa is stamped until march 9th 2012. If i travel in dec 2011 outside US with my current stamped visa and return before the start date of the newly renewed 797 (ie before say 5th march 2012), do i need to go for visa stamping ? Will there be any issue upon return? Can you please share your experience/opinions.. TIA. Link to comment
Attorney_22 Posted December 6, 2011 Report Share Posted December 6, 2011 Generally, as long as an individual is eligible to enter the U.S. in H1B status and does so prior to the expiration of their H1B visa, that individual should not encounter any problems. It is advisable however to carry with you not only a recent employment verification letter, but also the new I-797 H1B Approval Notice as it is likely the CBP officer will inquire if an extension had, or is going to be filed.
