victory99 Posted December 5, 2011 Report Share Posted December 5, 2011 My former employer X filed I-140 in EB2 with PD Oct 2007. They never gave me any details regarding 140. So I recently requested for I-140 approval letter through FOIA. it may take around 6 months to get the I-140 approval letter provided my employer X did not revoke it. My current employer Y (MNC) is about to file my I-140 soon in EB2 (PD July 2011). They will file the I-140 without capturing my earlier PD. Please advice how I can proceede to capture my earlier PD assuming that I will get the I-140 approval copy from FOIA. I exepect my 140 from Y will be approved by then. Appreciate your comments. Attorney_15 Posted December 6, 2011 Report Share Posted December 6, 2011 Transfer of a priority date should be possible even if all one has is the receipt number. Otherwise (and often in addition to) one can file a Freedom of Information Act request for copies of one's records that may be helpful on this point. Link to comment
