Stamping Issues in Hyderabad -Urgent

I am working as a FTE for one of the company and recently the company is going through Chapter 11 Bankruptcy so do you think is it the appropriate time or not to go to India for the H1 stamping.I am worried even though I have all the required documents (Client Letter, Paystubs ,W2).Please can you let me know your suggestions ASAP as my ticket if for December 7th.

You better not come unless and untill its an emergency. Be prepared for 221g. The timelines are very uncertain so u want to take care of ur stuff back there if u choose to come, in the sense come prepared for 221g and visa stamp time delays. It could get frustrating if u have everything setup there.

I would suggest engaging an attorney's counsel. Consulates may ask for financial reports (public company); the issue of ch11 may come up.

I spoke to my manager today and they have given a confirmation that I can go and come back even if I get a 221g i can work from India for about 1 month but if it's more than 1 month than they need to think about it.Can you please let me know if I should still think of going since I am guessing what would happen after 2 months if I get layedoff and then I would not have any supporting documents with me then.

Do not come untill and unless its an emergency. 221g response is not all predictable. It could take any where from one week to more than an year.

For u to get Visa, u need to prove that ur employer is qualified to provide employment to u and with ur Client's issue-I doubt how much VO can buy ur docs and give u a Visa.

But I was just thinking since it's the initial stage for Bankruptcy so there is better chance of getting my visa stamped rather than after 2 mnths when they start restructuring and laying off people what do you suggest I am really confused?

Why don't u contact an Attorney. You can get consultation for 200 bucks, atleast u can get some peace of mind. I am not sure when is the best time with your current company to get Visa. With Attorneys, it gets tricky if u are talking for the first time, as they go on and on about options, possible issues etc and be aware that they may give u an option which will 100% get u an Visa . But atleast u get to know ur options and make sure u write down all your questions before ur consultation, make sure to stop the Attorney and ask ur specific questions if u think he/she is deviating. It will give u some clarity and worth it in these times of crazy 221gs.

Yes I contacted my attorney and he says that it's the same in India or Canada and about the 221g's he says Bankruptcy might not effect my stamping it generally effects GC processing but these are the questions they might ask for stamping (just incase) of the client's issue:

1. About the Financial Reports

@grm77, why don't u contact an immigration specialist other than your company Attorney. Regarding the job security, probably if ur client letter says that u will have job untill the duration of ur H1 or for the next two years with extensions if neccessary, it should be ok. Do not bring about the bankruptcy issue untill asked and be bold and confident in your answers. But honestly, I am not a specialist, do not want to give u any false advice.
