dbusa123 Posted November 30, 2011 Report Share Posted November 30, 2011 Hi, I have a question on possible disadvantage of applying for a Green Card. I am now in US with a employment based H1B visa. My employer wants me to apply for Green Card right now. However there is a possibility that I may return back to my country permanently after 1 or 2 year. And even if I return back permanently, I may need to come to US on a business or tourist visa because of social or business ties that I have developed. Suppose I apply for GC now, and then after 1 or 2 years I abandon the process, most probably even before getting GC. After returning back to my country, if I apply for a non-immigrant visa (B1 or a tourist visa) to come to US temporarily, can I be denied because I have applied for GC before (i.e., show immigration intent)? Can I argue at that time, that I have adandoned the GC process as I did not have any intention to immigrate to US? Thanks. Link to comment
