H1B Cap exemption clarification

Hi Joe and experts,

Here is my timeline. I just want to check if i will be exempt from H1B Cap

First 3 years of H1 started on 2006 Jan 1st until sep 2008

After H1 extension applied, i got until Sep 2011

Extension applied again using My Labour approval and still waiting for my H1 Extension approval.

But in the period from 2006 to 2011 i was out of US for almost 1 year and still left with 1 year of H1 of my 6 years Quota.

Now that i am past due my H1 expiration date, if my H1 gets rejected, then what can i do?

Now that the quota is over, i wont be eligible to apply for another h1b from another company. Or will i be able to apply since i didnt use 6 years of h1?

Please help so that i can plan better for the worst
