My earlier EB3 employer-based PD has been ported as I requested porting during the I-140 stage. My question is am I supposed to attach all I-140 approval notices when filing I-485 or the latest one (EB2 NIW I-140 approval notice) should suffice? Thanks in advance. Link to comment
Belle Posted November 21, 2011 Report Share Posted November 21, 2011 You need to have the approval for your eligibility, which is your EB2 and you need to have some proof of your earlier PD. If your recent approval has it, you are done. Link to comment
kevin08 Posted November 21, 2011 Author Report Share Posted November 21, 2011 Thanks Belle, The EB2 NIW I-140 approval notice has captured earlier PD. When EB2 NIW was filed, I submitted LIN # of earlier approved EB3 I-140 petition since the employer has a policy of not sharing the I-140 approval notice. Now my questions is - when filing 485, I am attaching a copy of the EB2 NIW approval notice and mention the LIN # of earlier EB3 petition in the cover letter since I don't have a copy of the EB3 I-140 approval notice.
