Whats the next step - My H1B ( 6 yrs ) is expiring in Sep 2012. If I file my H1B extension - How many yrs I will be getting . Thanks for your reply in advance. Rgds/ Priya. Link to comment
Attorney_17 Posted November 21, 2011 Report Share Posted November 21, 2011 The USCIS will not accept H-1B extensions more than 6 months prior to the expiration of one's current H-1B status. If at least 1 year has passed since the filing of the Labor Certification, then a person can apply for 1-year H-1B extensions beyond the six year limit. In addition, if the I-140 petition has been approved and the person's Priority Date is not current, then a person can apply for 3-year H-1B extensions beyond the six year limit. Link to comment
