garg83 Posted November 19, 2011 Report Share Posted November 19, 2011 Hi I have a employer who wants to file a H1b visa for me but he says that I have to come on B1 visa first and he will file H1 once I am in US. He says he can file it with a day or two of me being in US. He is not asking any money from me. As I have wife and kids I will have to come back to India once the H1 is approved and have it stamped from India. Do you think anything wrong in this. Please advise and let me know more details like after how long(me being in US on B1) can he file H1 visa. Do I need to stay on H1 for some specific time before I can travel to India and bring my wife and kid. Thanks Garg Link to comment
JoeF Posted November 19, 2011 Report Share Posted November 19, 2011 Filing an H1 right after entering on B1 or B2 is a recipe for disaster. Such stuff would get denied. If he really wants to hire you, he can file an H1 right now without you being in the US. If he doesn't want to do that, stay away. It looks like a shady employer. Link to comment
