While doing so can the employer go ahead with advertisement process. 3. As soon as the employer receives the alternate wage determination can he file for the Perm. Will be glad to see some response. Attorney_9 Posted November 18, 2011 Report Share Posted November 18, 2011 If the employer wishes to use an alternate wgae survey in support of a labor certificaition, the company will need to submit that alternate wage survey information to the National Prevailing Wage Center as part of a Prevailing Wage Request to see if the DOL will accept it. If they do accept it, the DOL will issue a Prevailing Wage Determination listing that AWS data as the prevailing Wage. The employer can potentially begin advertisements while that prevailing wage determination is pending although there are some risks associated with that. It would be wise for you and your employer to consult with a competent immigration attorney to discuss your options and come up with an effective strategy for proceeding. Link to comment
