Attorney_15 Posted November 16, 2011 Report Share Posted November 16, 2011 We have heard of a case where an individual I-140 Beneficiary received an I-140 Request for Evidence mailed directly to them from U.S. Citizenship & Immigration Services when the Petitioner could not be located by USCIS. jj Posted November 16, 2011 Report Share Posted November 16, 2011 i received the RFE in last week of October and its sent to Attorney...I called up on toll free number and found that it will only be dicussed with Employer or...Attorney... Link to comment

Typically, USCIS will only talk with the employer or the employer's attorney when it comes to the I-140. What we learned of is an I-140 case where USCIS actually spoke to the employee. It appears that the facts of this case that we learned of were similar to the facts in Ravulapalli v. Napolitano (https://ecf.dcd.uscourts.gov/cgi-bin/show_public_doc?2010cv0447-14), a lawsuit filed by the Murthy Law Firm in which the federal judge ruled in favor of the Murthy Law Firm to continue the lawsuit on two claims against the government.
