Can a substitute EB2 labor for advanced degree be used to file I140 for me? If yes, then what are the documents that I would need to show proof of eligibility? Thanks! Link to comment
Attorney_15 Posted November 16, 2011 Report Share Posted November 16, 2011 I-140 substitutions, meaning cases where the LC was originally filed for another person, are no longer permitted by operation of Department of Labor regulation. One would have to sue DOL to overturn that regulation in order to pursue such a case. Link to comment
