Can get L2 visa with only valid I-94(L1)?

Hi,

I've I-94 validity till Nov 2014. But my visa is going to expire by Dec, 2011.

My wife is working in India with some other company. She wants to quit that job & come as dependent with L2 visa and also she wants to work here (EAD).

My question is, Can she come and work with my I94 only, with out having my valid Visa. What will the visa officer and port of entry officer basically look into?

Could you please suggest me for this scenario. This would be really great help. Thank you

If a foreign national is in valid L-1 status, his/her spouse is generally eligible to apply for an L-2 visa. The validity of the visa will not generally impact the L-2 visa application.

Thanks for your response. I will send my L1-B papers, visa (Validity may expire by that time) and I94 copy to her. So that she can apply for her L2 visa. Thank you once again.
