L1 Visa and I 94 expired - On L1 Extension and received RFE - Can I go for a new H1 B

Hi ,

Let first thank you for reading this post and taking time. I have a strange scenario and am writing this to get the expert comments. Below is my situation -

I'm on L1 extension right now, and got an RFE a month ago. Both my L1 visa and I 94 are expired on July 21st 2011 at the moment. Now, I have a new employer, who is willing to file a new H1 B visa. So here goes my questions -

1> Should I wait till my L1 extension gets approved before filing a new H1 B visa (or) can the new employer move forward with H1 B filing.?

2> What will be the impact in terms of the "out of status", just in case my L1 extension gets denied.? Will this impact any of my future visa processing and how this can be handled.?

3> What is your suggestion to handle this situation. Please help me.
