riju.itengg Posted November 14, 2011 Report Share Posted November 14, 2011 I am in USA since last 1year with H1B visa.My visa getting expired on May,2012 but it can be extended as it is a new visa.Now I want to apply for a new L1B visa so that my wife can work here with L2 EAD.I want to know if during the time of visa interview I will be asked by USCIS about the reason behind this what should I give the justified explanation to convince them? Attorney_23 Posted November 16, 2011 Report Share Posted November 16, 2011 If a foreign national in H1B status also qualifies for L-1 status, his/her employer is free to either file a new petition on his behalf, or file to change the employee's status. The fact that a foreign national's spouse wishes to work pursuant to L-2 status is not a relevant consideration under immigration law. (I also fail to see how a desire to work constitutes being 'greedy'...) Link to comment
