I140 - Switch from EB3 to EB2

Hi,

My employer made a mistake and got my I 140 in EB3 in 2008. The PERM labor was for Masters degree, I think when they applied for I140 they made a mistake. As per EB2 the date is current now. When applying for I485, I found out that my I140 is EB3 but not EB2. Sad !!

What options do I have ?

How do I proceed ?

Do I need to get a new labor and then apply for new I 140 in EB2 and port my PD ?

Do I just need to apply for I140 in EB2 and port date. WiIll my 2007 Labor be valid since it was utilized ?

Any suggestions are appreciated !
