samniceguy Posted November 12, 2011 Report Share Posted November 12, 2011 Hi I wanted to know if there are any problems in transferring H1 b visa to an employer who uses PEO (people employment organization ) as a co-employer. I have researched on the USCIS website that it does recognize PEO's role in corporate america on web-page discussing about the e-verification process. http://www.uscis.gov...000082ca60aRCRD I wanted to know that even after the H1 approval will I have to face any issues during the stamping process due to the fact that my pay stubs and W2's will have the name of PEO on them. Also any issues that I may have to face with filing the green card or future H1 B transfers. Any one sailing in the same boat as me please let me know your experiences. Link to comment
Attorney_7 Posted November 14, 2011 Report Share Posted November 14, 2011 Generally, USCIS recognizes PEO arrangements for H1b employment as long as the arrangement is clearly explained and documented in the petition. It is recommended that the POE company and/or the H1b employer issue a statement explaining the outsource functions. Link to comment
