Dear All,

Appreciate your time in advance for replying to this:

My L1B Visa got expired on 14-Oct-2011. My company filed a extension request before oct 14 and i got an RFE on Oct 21st. Now i have time till Jan 16th 2012 to respond.

here are my questions.

1) If i respond to RFE (Most of the questions are on special Skills) how much more time i can stay in US?

2) If RFE gets rejected, within how many days i need to leave US.

3) If RFE gets rejected, after how many months i can apply a new visa from India

I'm running on a notice period in my apartments and your reply will help me plan accordingly in case of my return to India.

Kindly help.

Ordinarily, if a petition to extend L-1 status is timely filed on behalf of a foreign national, the foreign national may continue working for a period of up to 240 days while the petition is pending. If the petition is denied, the foreign national is not provided any type of grace period. Rather, he/she is generally required to cease working and leave the U.S. immediately. However, the foreign national may then apply for a new visa at any time.
