EB1C - Query

My H1 will max out in Jan 2012

Currently my EB1C is under process in Texas Service Center and the current status is

EAD - Approved

Advance Parole - Approved

I140 - Approved

RFE's : None

I485 - Awaiting approval for the past 4 months and there is a lot of delay for some unknown reason

Please advice me which one of the below processing is easier and would help me to extend my H1B for a longer period of time till my I485 gets approved

Option 1 : Use EAD which is valid till Jun 2012 once my H1B expires

Does this require any other processing to update my status from H1b to EAD

Option 2: Extend my H1b to 3 years using the approved I140

please consult a lawyer.

option 1 and 2 is viable. you will need to update I-9 information on option 1 and option 2 would require your employer to file H1 extension for you.
