kavin Posted November 8, 2011 Report Share Posted November 8, 2011 My H1 will max out in Jan 2012 Currently my EB1C is under process in Texas Service Center and the current status is EAD - Approved Advance Parole - Approved I140 - Approved RFE's : None I485 - Awaiting approval for the past 4 months and there is a lot of delay for some unknown reason Please advice me which one of the below processing is easier and would help me to extend my H1B for a longer period of time till my I485 gets approved Option 1 : Use EAD which is valid till Jun 2012 once my H1B expires Does this require any other processing to update my status from H1b to EAD Option 2: Extend my H1b to 3 years using the approved I140 Link to comment
redgreenbluee Posted November 9, 2011 Report Share Posted November 9, 2011 please consult a lawyer. option 1 and 2 is viable. you will need to update I-9 information on option 1 and option 2 would require your employer to file H1 extension for you.
