Reconsideration Requests to the CO

Hello,

Need some help.

My EB3 perm was filed in Jun 2009, received RFE in Jun 2010 and Denial in Mar 2011. My attorney said it will take 2 years to get a response on denial during which i can get another H1 extension for my 9th year. However DOL website said priority date for Reconsideration Requests to the CO is Sept 2009. Has the process been expedited and my case probably already closed?

My employer is currently going through a transition of attorneys, so I am not receiving any updates from either my employer or any of the attorneys. My next H1 extension is due in June 2012.

Another question related to the above topic. If the CO denies, does the case go to BALCA automatically and how long can BALCA takes (based on current processing time) to give a decision. Looks like everything has been expedited.
