EB3 to EB2 Portability

Hi,

I applied I 485 under EB3 category with Pre- approved labor(Not my labor) . My priority date is march 2005. Now I am working on EAD with other company. Now I am planning to do EB2 process with new company. My question is

• If I applied the EB2 category now Can I port my pre-approved labor date to my new EB2 process?

If your I-140 is approved, then old PD can be ported.

Hi

I have applied my GC in EB3 , I140 got approved. Since my current company policies have changed , I again applied labor in EB2 with the same company but I had an RFE then it got denied.

I got an email from the attorney saying that they are going to reappeal for this as it seems to be an error ?(which I didn't understand ) .

I have two questions

1. Can reappealing helps?

2. Do I need to go for a fresh application in EB2
