heathrowguy
Hi, I would really appreciate if anyway can help me out here. I have a approved labor in EB2 category with Priority date of Jan-2008. My HR filed my I-140 in April,2011 and i got the approval notice in October. But there was an error in filing and the USCIS did not notice it. The location where i will be working (Section H, Question 4 in I-140 application) was mentioned incorrectly, by mistake. The address mentioned in I-140 is not matching the address mentioned in the Labor Certification (ETA-9089). Is there a way this can be corrected? Can my attorney/Employer send a letter to USCIS letting them know about this mistake and correct the form? I would rather get this corrected myself before USCIS notices it and sends an RFE.. I would really appreciate if anyone can please give me some advice here. thanks Prema Link to comment
Belle
I think, this needs an I-140 ammendment.Talk to the attorney about it. Link to comment
Attorney_6
If the mistakes are serious enough, maybe an amended I-140 would be appropriate as a proactive measure. Link to comment
heathrowguy
Belle and Attorney 6, Thanks a lot for your response. Do you know an amendment to an approved I-140 means re-filing the I-140 again? In other words, will USCIS reprocess my I-140 as a new application once we amend an existing approved I-140? Please let me know. Link to comment
