vicrf Posted October 28, 2011 Report Share Posted October 28, 2011 Hello, I'd like to hear from you. I am in my 7th year of H1b visa. I lost my job in January 31st. I tried to find a job but I only got an offer in mid-September. By then I was out of status, I know, but my H1b visa and my I-94 were still valid until October 1st. The attorney filed my H1b with this new company by mid-September, that is, before my h1b + I-94 expired. He filed Premium, and my visa was approved October 6th, without I-94. Instead of going back to my country, I was planning to file for a Canadian temporary visa to get the stamp in Vancouver, as I am in Seattle right now. However, I read somewhere that if a person ever was out of status in the US, they suggest to get the stamp in your home country. So I would like to know if anyone here had this same situation. So, I was out of status, but not illegal, and my visa was filed before my I-94 and previous H1b expired. Do you think I have any chance of getting 1) the temporary visa to enter Canada in this situation, and 2) any chance of having the stamp in Vancouver even without paystubs for almost 8 months? rasu1 Posted October 31, 2011 Report Share Posted October 31, 2011 Based on my personal experience, I would suggest you to go to your home country. Nowadays 221g is pretty common. If you get stuck on this you never know when you'll be getting visa. Also hope you haven't crossed 179 days out of status. Link to comment
