rwanchoo Posted October 28, 2011 Report Share Posted October 28, 2011 My new employer has filed for my H1 transfer and I expect the approval to come in next 30 days. But I need to travel to india for 2 weeks starting 15Nov (while my H1 transfer is still in processing). Can i continue to my india trip? I will still on valid H1 from my current employer during my india travel and I will resign (change employers) only once i come back to US after 2 weeks. Link to comment
Attorney_10 Posted November 7, 2011 Report Share Posted November 7, 2011 Generally, an individual must be in the U.S. when an extension of stay is filed in order for the application/petition to be approved with an I-94 card attached to the approval.
