h1hopeful Posted October 20, 2011 Report Share Posted October 20, 2011 My case: EB3 PD: Sep '07 I-140: Approved back in '08 Got my masters last year and got promoted to EB2 level this year so my company filed for EB2 PERM in Aug of this year which will hopefully be approved in the next couple of weeks. With the Nov. bulletin my PD is current under EB2. My question is, once PERM under EB2 is approved can we file for I-140 and I-485 simultaneously and still recapture the EB-3 PD? Is it possible to do that or is that too much concurrency for INS? I-140 question: I am going to start my 4th year of H1B next week, am I eligible for premium processing for I-140 or is it still limited to those who are nearing end 6 years of H1B? My lawyer is suggesting doing I-140 first with premium processing, recapturing the old PD and then filing for 485. Is that better or worse or makes no difference in terms of timing? Thank you!
