indian_boy007 Posted October 19, 2011 Report Share Posted October 19, 2011 Hi, I am currently working on H-1B which has started from October 1st, 2011 (so just 19 days back). Now I have another offer and they want me to start from November 7th, 2011. They still haven't sent the documents to the USCIS yet, they may sent it in a day or two. My questions are: - Is it possible for me to really start working on November 7th? - I have to give a 2 week notice to my current employer. So the latest I can inform my current employer is by this Friday. What actions my current employer can take against me? The attorney of the new company is insisting that it is absolutely safe to start on November 7th, 2011. But I am a bit worried. Your help is greatly appreciated. Thanks. Link to comment

While I was working on my OPT job, I applied for my H1 B Visa for 2011 through a desi consultancy and it got approved from Oct 1st 2011(Got my 797). I continued my work until Oct 15th, as my emp(desi company) told to continue and if I get the project I can move to H1B and start using that. But now I got one more Full time Offer from a American company, They are ready to do H1B , What should I be doing in this case. Can I apply for brand new H1B? Or should I say it as transfer(I dont have pay stubs from that desi company) But instead I have pay stubs of my OPT until oct 15th(Pay is less). Pleaseeeeee help me what can I do in this case. SHould I say to the new company that I am on OPT or H1B. Thanks in advance Link to comment
MOG Posted November 6, 2011 Report Share Posted November 6, 2011 You can start working for the employer as soon as they get a receipt from the USCIS. You do not need to wait for approval. I did that and had no problem extendind H1-B visa in 3 years with that employer. http://www.*************** Link to comment
MOG Posted November 6, 2011 Report Share Posted November 6, 2011 As for as your current employer, if you are transferring to a competitor to your current company, you might be escorted out of the building within 10-15 minutes once your current employer finds it out. So, be prepared for the worst with a current employer in this case. However, it looks like that you shouldn't worry about it since you can start working for another employer tomorrow. Link to comment
