nikeng Posted October 19, 2011 Report Share Posted October 19, 2011 Dear Sir, 1 ) My current H1-B Petiion was valid only till 14th Oct, 2 ) I have 1 month left out of total 6 years of H1-b validity 3) My GC labor was filed last year on 26th Oct 2010 and it's currently in pending status So there is a gap of 12 days between of H1-B Validity (14th Oct ) and Perm pending over 1 year( 26th Oct 2011) Instead of filing two extension , First for claiming 1 month of time remaining on H1-B and after 26th oct 2011 , applying for 1 year extension based on perm pending over 365 days My company filed one 13months extension for me ( on 12th Oct). They said that as there are only 14 days left in hitting one year for your perm date , we don't need to apply for two extension in such a short period and in one extension we can claim 13months My Question 1 ) What are the chances that my case will get approved as we have filed for 1 year extension based on pending perm before 12 days of 365 days. this extension will also take care of my 1 month remaining time on 6 years of H1-b validity 2) I understand that based on this pending application I can stay in US for atleast 240 days.
