If I plan to join a fellowship position next year for 2 years, is it possible to get an extension of H1 based on Fellowship position, with out some one filing for a GC before my 6th year? Or is it better to change to J1? Link to comment
Attorney_22 Posted October 24, 2011 Report Share Posted October 24, 2011 Generally, an individual who received an H1B approval is entitled to a full six years of stay in the U.S. in H1B status provided they are engaging in qualifying and authorized employment. An extension beyond the six year limitation is only possible in the event an H1B beneficiary has a valid labor certification application that was file more than 365 days prior to the H1B sixth year expiration, or an approved I-140 petition.
