kalva1kk
My I-140 got denied as it wrongly applied under EB2 category so my attorney is going re-file I-140 under EB2 category. My question is can we re-file I-140 in Premium Processing? Thanks, Kumar Link to comment
Attorney_9
No, you cannot refile the denied I-140 with premium processing. In order to file PP, you must include the original labor certification with the filing. Link to comment
maryland24
A new question: My H1-B visa is ending Dec 23rd 2011. My company filed PERM (EB3) on March 30th 2011, and got approved on May 23rd 2011. I-140 was filed on July 20th and RFE was issued on August 9th. The reply was sent and now it has been denied on Oct 24th 2011. I don't have the exact reason for the RFE and the denial. 1) Am I eligible to re-apply fresh I -140 application in premium under EB3? - As on my PERM it says my Certification is valid from 05/20/2011 to 11/16/2011, if yes, should I apply it before 11/16/2011 Link to comment
