L2 EAD - I-94 Expiry Valid Visa

I filed I-765 (EAD) online on 23^rd July 2011.

An RFE was issued on 6^th Sep 2011 asking for mine and My husband’s visa, I-94, passport and marriage certificate copies.

I replied to the RFE, and it was received on 23^rd Sept 2011 with the below details

L1 B , valid till 22^nd Sept 2012

Valid till 18^th Nov 2011

My old passport was getting expired on 18^th Nov 2011, that’s the reason my I-94 is valid till 18^th Nov 2011.

I have got a new passport which is valid till 2021.

Now as my I-94 is not valid for very long, I went to CBP office in JFK and Newark, They did not correct the date.

Should I go out of USA and get a new I-94.

Now my question is , Should I send USCIS my new I-94, Will they consider my new i-94, my case was registered 82 days before and they got the REPLY for RFE from me on 23^rd Sept 2011.

Or , USCIS will grant decision based on my old i-94.

Could you please suggest something so that my EAD does not get denied.

Should I write a mail to USCIS saying that I will be sending them my new I-94.Please help.
