I was without salary from employer in bench for 5 months in 2009 recession.. - -Is that going to create problem in 485 filing? -Is USCIS going to ask for last 3 years W2 and pay slips? -What precautions I need to take here filing 485? Belle Posted October 11, 2011 Report Share Posted October 11, 2011 It might or might not create a problem. Generally, when filing AOS you are protected if your out status period is less than 180 days. Also, it helps to leave the country and re-enter after an out of status period and before filing I-485 because the law says you need to maintain status from the date of the last lawful entry. The tax returs are not required for the filing, but the USCIS always may ask for additional documents as they see fit. Link to comment
