Pending 485 Vs. Pending COS H4 when filing for 485.

Hi All,

My H1 expires Nov 2, 2011 and I was planning to file for H-4 status after that and wait for my wife's PD (07/25/2007) to become current to join as a dependent.

Now, my wife's PD is current in Nov Bulletin. If we make sure the application reaches on Nov 1st, then I will not have to file for H-4 status as I will be under the "Pending 485" status.

Am I considered to be out of status, for the number of days between the "485 filing date" and "receipt received date"? Will this create a problem, when the officer is making an AOS decision?

OR

Is it safe to file for COS to H4 right now and THEN put in the 485 application with my current status as pending H4 COS.
