Illinois_Dude Posted October 7, 2011 Report Share Posted October 7, 2011 I work for a major US corporation. 3 years ago the company had filed my GC in the EB3 (India) category with a priority date of May 2008 (I-140 approved). This year I moved to a different division within the company with a promotion and they have agreed and started working on a new petition in the EB2 category. With all the prevailing wage delay and PERM processing times,it looks like my PERM could be approved sometime in March 2008. If my EB2 PERM is approved and my original PD (May 2008) is current at that time,can I do a concurrent filing with a request to port my PD from my EB3 petitition to EB2 petition ? Or can I file only my I-140 and wait till it is approved before filing the I-485 ? Link to comment
