If i join to a new employer (he is going to file a new Perm, I140) 1.can i use the same priority date. Can my old employer revoke the visa or labor, I140 approval ? will it affect my new green card process(Perm, I140) or in the priority date. Please suggest !! Thanks in Advance... Link to comment

If I decide to change my employer, & if my current employer revokes his I 140, will I be able to retain my PD? Belle Posted October 7, 2011 Report Share Posted October 7, 2011 Your I-140 has next to no impact on your ability to change jobs. To change jobs all you need is proper work authorization. What is going to happen with your green card is a different matter. Generally, your won't be able to file based on the old I-140, and the new employer will have file a new one. You can use your old PD if your old I-140 is not revoked for fraud. Link to comment

Dattguru Posted October 8, 2011 Report Share Posted October 8, 2011 You will be able to use your OLD PD as many time as you file your applications, however any new I-140 approvals will get ported to the OLD PD ONLY IF your old I-140 has not been revoked till you file your new I-140. Link to comment
Belle Posted October 9, 2011 Report Share Posted October 9, 2011 You have to have some proof of your earlier PD. Talk to a lawyer. At least, you should get your A number that has been assigned to your approved I-140. You can probably figure it out from there. And it is incorrect that if the employer withdraws your I-140, you lose the date. Simply wrong. Link to comment
