H4-Visa - Suggestion needed ASAP

Hello,

I am on my H1B Visa. My Visa is going to expire on 12/31/11. I am starting my renewal in regular Quota. My wife has the same expiration date on her H4 Visa and i-94. My wife is travelling to India in NOV due to personal reasons. And she will be back in Dec 1st week.

I have been suggested that my wife needs to wait until it is approved (In regular or Premium process I dont think it wont be approved so soon in the currrent situation) or we have to file the extension for her (H4) after she gets back.

Will there be any potential issues at the port of entry when she is back in US? e.g. like if they ask why havent you and your spouse didnt apply for an extension? Your i-94 is getting expired shortly and why should we allow you entry in US?

Does anyone had been in the same siutation?

Please share your experience or suggest me what need to be done.
