radsr Posted October 5, 2011 Report Share Posted October 5, 2011 This may be a situation which would have discussed before but couldnt get the specific scenario Situation Currently on L1 which expired on Sep 8th Filed Extension on Augst 5th Got RFE on Oct 3rd Same Company ready to file H1 Is it possible to file h1b under premium / regular at this point ( let say oct 5). Or am i out of status to file h1b while i am in US. When i say i am in Out of status it means my stay is based on the extension filed on Aug 5th Link to comment
