I don't want COS even after I get my H1 so I get time for formally resigning and changing the job. Is there any two step process and how i can make sure the new employer don't apply with change of status. Link to comment

Attorney_23 Posted October 6, 2011 Report Share Posted October 6, 2011 As Transformer indicated, the petitioner can file a straight petition without requesting a change of status. However, keep in mind that if you take this route, you would then ordinarily have to leave the U.S. to apply for a visa and then re-enter in H1B status. Link to comment
