robertlucent Posted October 1, 2011 Report Posted October 1, 2011 Hi, there: I have my 140-NIW approved recently. But due to the visa backlog and due to the job market in the US, I am planning to go back to my home country and work for several years until the PD is current. When I filled out the 140, I chose "Adjustment of Status". My question is will I abandon my 140's approval if I stay outside the US for such a long time? Can I switch to consular processing when the PD is current several years later? Thanks Robert
Belle Posted October 2, 2011 Report Posted October 2, 2011 Get a consultation with a lawyer. I don't thing I-140 can be abandoned, but you will probably need a job offer and possibly need to switch to CP.
robertlucent Posted October 5, 2011 Author Report Posted October 5, 2011 Thank you very much for your reply. Yes, I have got confirmed that I can keep my I-140, and I need to file another form to switch to CP.
