nipukumar Posted September 30, 2011 Report Posted September 30, 2011 Hi, I have a question. Based on I140 approved how many long or how many times H1B can be extended for the following situation. It can be extended for one 3 year period if PD is not current after I140 approval. Now if i leave the current employer with whom i have I140 approved and move to another one in the mean time, 3 years has elapsed my PD is not current. New employer has not started green card yet. Can i extend the H1B for some more time, based on my prior I140 approval ? Thanks,
Attorney_17 Posted October 3, 2011 Report Posted October 3, 2011 Yes. As of this writing, an individual can continue to apply for 3-year H-1B extensions beyond the six year limit as long as the PD is not current and the previously approved I-140 has not been withdrawn/revoked.
