H4 Extension RFE - h4 already expired - Urgent

Hi,

I got my h1b transfered in Jan 2011 and forgot to extend my wife h4. Applied for h4 extension (I539) on 9th August 2011 (h4 exipred on 26th September 2011) myself through e filling. Got RFE on 28th Sep 2011 for 797 and I 94 for applicant spouse. Expert please help with these questions:

1) Is she out of status right now ?

2) Do i need a lawyer to handle this?

3) I have send all supporting document to them at time of e file, do I need to give reference of that or send other documents togehter with 797 and i 94?

4) Can I request to expedite the process now.
