Skill Level Selection

I'm having some trouble with the Skill level selected for my PERM. My specific question is:

Who selects the Skill Level for the position? Is it the attorney?

My job title is Materials Scientist with a minimum education requirement as Ph.D. Job description involves being a Technical Lead and Project Manager on extremely complex problems. However, I see that a Skill Level 1 has been selected.

I want to know if the Skill Level is something that the immigration attorney determines or is this determined by DOL.

The wage level is selected by the Department of Labor at the time of Prevailing wage determination based on a comparison of the job duties and requirements with what is normal for the occupational classification.

Attorney_9, would wage level be used as a base in classifying of EB category? If so, within levels 1, 2, 3 & 4 which ones would classify for EB2 and EB3?

If I am completely off the base, please help me understand what would determine a position to be classified under which EB category?
